Faith & Freedom Coalition Commends the Decision of the Supreme Court to Require Unanimous Jury Verdicts, Despite Criticism From the Left

DULUTH, Ga. – On Monday, the Supreme Court said that unanimous jury verdicts are required in state criminal trials for serious offenses. Justice Neil Gorsuch penned the opinion and was joined in key parts by Justices Ruth Bader Ginsburg, Sonia Sotomayor, Stephen Breyer and Brett Kavanaugh. Faith & Freedom Coalition commends them for making this decision and for the bipartisanship of the majority that joined in the opinion.

The case centered on Louisiana and Oregon, as both states allowed non-unanimous jury verdicts for serious criminal offenses. The court said unanimous verdicts were required, invalidating prior precedent. However, there is dispute about when the court should overturn precedent, an issue that could come up this spring in an abortion case out of Louisiana. The liberal media is criticizing the court for overruling precedent that has been in place since the early 1970s.

Kavanaugh explains in his statement that, “the doctrine of stare decisis does not mean, of course, that the Court should never overrule erroneous precedents. All Justices now on this Court agree that it is sometimes appropriate for the Court to overrule erroneous decisions.”

“The justices have made a good case and one that you would think the Left would agree on; however, we are seeing so much criticism from the liberal media.” said Faith & Freedom Coalition Executive Director Timothy Head. “The Left should agree with the protection of the accused.”
